Envirocare FYl -I got from SECY, and provided to a reporter, a copy of a letter dated March 10 and served today. March 11 regarding the NRDC request for Commission review of the staff dental of NRDC's petition of January 8 re Envirocare.

the request for Comission The letter denies (on John Hoyle's authority) discretion.

Comission review of a director's decision will be entertained (quest fo review, because Comission review is at their No re 2.206(c)(2).

The letter further notes that the Comission has decided not to review the director's decision, and therefore it became final agency action on March 4.

However, portions of the NRDC letter regarding Utah's status as an agreement state have been referred to the NRC staff for consideration and reply.
