ORDER APPROVING APPLICATION REGARDING FORMATION OF A HOLDING COMPANY OVER NEW YORK STATE ELECTRIC & GAS CORPORATION AFFECTING LICENSE NO. NPF-69, NINE MILE POINT NUCLEAR STATION, UNIT NO. 2 (TAC NO. M99662)
Dear Mr. Rafferty:
The enclosed Order responds to the application of September 18,1997, as supplemented by letters of October 20 and 27,1997, and January 6 and February 9,1998, from New York State Electric & Gas Corporation (NYSEG) through counsel. These submittals request approval, pursuant to Section 50.80 of Title 10 of the Code of Federal Renulations (10 CFR 50.80), of the proposed indirect transfer of Facility Operating License No. NPF-69, to the extent it is held by NYSEG, to an unnamed holding company to be created over NYSEG in accordance with the executed " Agreement Conceming the Competitive Rate and Restructuring Plan of New York State Electric & Gas Corporation." The staffs safety evaluation in support of the Order is also enclosed.
The Order has been forwarded to the Office of the Federal Register for publication.
