NOTICE OF VIOLATION, AND EXERCISE OF ENFORCEMENT DISCRETION
Dear Mr. Kingsley:

On March 6,1998, the NRC completed an inspection at your LaSalle facility. The enclosed
report presents the results of that inspection.
Based on the results of this inspection, the NRC determined that a violation of NRC
requirements occurred. The violation is cited in the enclosed Notice of Violation (Notice) and

the circumstances surrounding it are described in detail in the inspection report. The violation is
of concern because it resulted in the inadequate control of the modification process. This is of
.
particular concem since you are in the process of completing a number of modifications at your
l
facility.
You are required to respond to this letter and should follow the instructions specified in the
i
enclosed Notice when preparing your response. The NRC will use pur response, in part, to
determine whether further enforcement action is necessary to ensure compliance with
regulatory requirements.

Also during this inspection, one other activity appeared to be in violation of NRC requirements.
i
This violation is of concem because adequate control of equipment installation during initial
plant construction and during modifications is important to ensure that systems are capable of
performing their function when called upon. However, after reviewing this violation and
following consultation with the Director, Office of Enforcement, because this violation was
' baswd upon activities prior to the events leading to the current extended plant shutdown and
satisfy the criteria in Section Vll.B.2, " Violations identified During Extended Shutdowns or Work
Stoppages," of the " General Statement of Policy and Procedures for NRC Enforcement
/
Actions," (Enforcement Policy), NUREG-1600,'a Notice of Violation is not being issued.
Specifically, the violation was licensee-identified as a result of a comprehensive program for
/
problem identification and correction that was developed in response to the shutdown, the
violation would not be categorized at a severity level higher than Severity Level ll, and the
violation was not willful. In addition, actions specified in Confirmatory Action Letter
Rlli-96-008B effectively prevent the licensee from starting up LaSalle County Station without
implicit NRC approval.
