Dear Dr. Asmussen:

This 6 in response to your letter, dated March 31,1999, and associated affidavit with the same date (Attachment to your March 31 letter) requesting that information concerning decommissioning cost estimates be withheld from public disclosure pursuant to 10 CFR 2.790 ,!

of the Commission's regulations.  !

The affidavit states that the submitted information should be withheld from public disclosure for the following reasons:

'1; .The information contained in the document has been held in confidence by General Atomics in that it is of a privileged and confidential commercial nature.

2. The information contained in the document has not been made available to public sources by the General Atomics, nor has General Atomics authorized that it be made i available. )

3. The public disc!c:;ure of the information contained in the document is likely to cause substantial economic harm to General Atomics.

On the basis of your submittal, our review of the above listed document, and in light of the ]

requirements of 10 CFR 2.790(b)(4)(i) through (v), we have determined that the above listed 1 document should be withheld from public disclosure pursuant to 10 CFR 2.790.

Asmussen 2 Withholding from public inspection shall not affect the right, if any, of persons properly anu directly concerned to inspect the documents as provided for in 10 CFR 2.790(b)(6). If, at any time in the future, the basis provided in your submittal for withholding information from public disciosure should change such that the inforrr.ation could then be made ava"able for public inspection, General Atomics should promptly notify the NRC. General Atomics should also be aware that the NRC may have cause to review this determinaticn in the future, such as if the t

scope of a Freedom of Information Act request includes your information. In all review situations,if the NRC makes a determination adverse to the above, General Atomics will be notified in advance of any public disclosure.
