This is in response to your letter and affidavit, dated March 31,1999, requesting that information' concerning decommissioning cost estimates be withheld from public disclosure pursuant to 10 CFR 2.790 of the Commission's regulations.

You stated that the submitted information should be exempt from mandatory public disclosure for the following reasons:

The information contained in the document has been held in confidence by General J

Atomys in that it is of a privileged and confidential commercial nature.

The inbrmation contained in the document has not been made available to public sources by the General Atomics, nor has General Atomics authorized that it be made

On the basis of your submittal, our review of the above fisted document, and in light of the l

requirements of 10 CFR 2.790(b)(4)(i) through (v), we have determined that the above listed

document should be withheld from public disclosure pursuant to 10 CFR 2.790.

Vithhoiding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents as provided for in 10 CFR 2.790(b)(6). If, at any l

time in the future, the basis provided in your submittal for withholding information from public j

disclosure should change such that the information could then be made available for public -

inspection, General Atomics should promptly notify the NRC. Genercl Atomics should also be l

aware that the NRC may have cause to review this determination in the future, such as if the

scope of a Freedom of Information Act request includes your information, in all review situations, if the NRC makes a determination adverse to the above, General Atomics will be notified in advance of any public disclosure.
