Gentlemen:

SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT 50-382/91-03)

This refers to the inspection conducted by Messrs. W. F. Smith and S. D. Butler

of this office during the period January 9 through February 19, 1991.

The

inspection included a review of activities authorized for your Waterford Steam

Electric Station, Unit 3, facility. At the conclusion of the inspection, the

findings were discussed with those members of your staff identified in the

enclosed report.

Areas examined during the inspection are identified in the report. The areas

included plant status, onsite followup of events, monthly maintenance

observation, monthly surveillance observation, operational safety verification,

licensee event report followup, and preparation for refueling. Within these

areas, the inspection consisted of selective examination of procedures and

representative records, interviews with personnel, and observations of the

activities in progress.

Based on-the results of this inspection, certain of your activities appeared to

be in violathn of NRC requirements, as specified in the report and in the

enclosed Noti e of Violation (Notice). We are concerned about the violation

cited in the enclosed Notice because of a similar violation on June 21, 1990,

when a postmodification retest procedure for the control room air conditioning

system was implemented without the required reviews by the plant operations

review conuittee. Your corrective action, which was completed by

December 31, 1990, did not appear to have been effective in preventing a repeat

violation on January 15, 1991. We are also concerned about the two noncited

violations because they indicate inattention to detail on the part of

engineering and technical support personnel in the areas of surveillance

testing and design changes. The actions you are continuing to take to improve

human perfomance at Waterford 3, and the actions you have taken to correct the

specifics, were found to be adequate. Ther^ fore, these licensee-identified

violations are not being cited because the m :ttria specifSd in Section V.G.

of the NRC's Enforcement Policy were satisfied.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing jour response.

One unresolved item was identified in paragraph 3.2, regarding conditions found

-in the steam bypass control system that may have placed the plant outside of

its design basis. An unresolved item is a. matter about which more information

'is required to ascertain whether it is an acceptable item, a deviation, or a

violation.-

~ We have also examined actions you have taken with regard to previously

identified inspection findings. The status of these items is identified in

paragraph 7. of the enclosed report.

The response directed'by this letter and the acconipanying Notice is-not subject

to the clearance procedures of the-Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, PL 96-511.
