SUBJECT:

FRAMATOME COGEMA FUELS (FCF) REQUEST TO WITHHOLD PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE

Dear Mr. Taylor:

In April 1997. NRC issued a Safety Evaluation for Report BAW-10186P. " Extended Burnup Evaluation." that contained limitations on predicted claading corrosion levels. Subsequent to the issuance of that evaluation. FCF conducted telephone conferences with NRC and its contractor Pacific Northwest National Laboratory to reach agreement on interpretation of some items not explicitly addressed in the evaluation.

On August 29, 1997. you sent a letter to NRC to l

document FCF's understanding of those agreements. Also in that letter, you submitted an affidavit dated August 29. 1997. reqwaing that Attachment 1 1

containing those agreements, be considered proprietary and be withheld from public disclosure.

The affidavit stated that the information in Attachment 1 should be considered exempt from mandatory public disclosure for the following reasons:

(a) The information reveals data or material concerning FTI research or development plans or programs of present or potential economic advantage to FTI.

(b) The use of the information by a competitor would decrease his expenditures in time or resources in designing, producing or marketing a similar product.

We have reviewed the submitted material in accordance with the requirements of 10 CFR 2.790 and have determined that the affidavit provides an insufficient basis for withholding the indicated information from public disclosure and that the disclosure of the information to the public would not cause substantial harm to the competitive position of FCF. Additionally, the right

, puss of the public to know the information outweighs any concern for the protection of the competitive position of FCF, Therefore, we have concluded that no portion of the document is proprietary.

Due to our determination we intend to place the subject document in the NRC Public Document Room (PDR) in 30 days from the date of this letter.

If you wish to withdraw this document you may do so within the 30 day time period, t
