Chairman Jackson's Comments on SECY 97-273 I approve the staffs proposed approach for improving the control over NRC's generally licensed i

devices. However, as proposed by the staff, none of the options for the initial Registration l

Group, E.1, E.2, or E.3, cover the scope of the devices identified by the Joint Agreement State /

NRC Working Group (WG). The sources identified within the scope of the WG proposal represent sources that the staff recognizes may pose a significant risk to the health and safety of members of the public and the environment should they find their way into the public domain.

As such, within NRC's mandate to protect the public's health and safety, I recommend that the staff pursue a registration program whose scope includes the sources recommended by the WG and which provides for follow up for unaccounted sources to the extent that resources can be reprogrammed from other areas. The staff should inform the Commission as to the resource implications and reprogramming that will be necessary to implement the registration program of l

this scope.

it should also be noted that I recognize the possibility of implementing the initial registration l

I program through finalization cf the 1991 rulemaking. However, the scope of that rulemaking l

was much 'oroader than the currently proposed rulemaking and did not consider the fees among l

other issues. As a result, the factors involved in the cost benefit analysis of that rulemaking are I

no longer current or applicable because of the change in the scope recommended by the Working Group; therefore, the validity of the rulemaking would be open to unnecessary attack.
