l APPLICANT'S OPPOSITION TO CANT'S MOTION TO RECONSIDER 1

I On September 5, 1997 Citizens Against Nuclear Trash (" CANT") requested reconsideration of CLI-97-11, dated September 3,1997. Applicant Louisiana Energy Services, L,P. ("LES") opposes such motion. The motion presupposes Commission action regarding the outstanding petitions at issue. The Commission has yet to act on such petitions, and thus the underpinning of the motion is in error. Moreover, since the Commission has neither granted nor denied the outstanding petitions at issue, 10 C.F.R. $2.786(b) prescribes the procedure to be followed with regard to petitions for review; the instant motion does not comply therewith and should be denied, particularly since CANT has already had an opportunity to present its views on these matters.

Further, notwithstanding CANT's suggestion to the contrary, the Comm'ssion has correctly noted in this case (CLI-96-08) that it is capable of resolving matters raised in petitions for review 9709190010 970909 PDR ADOCK 07003070 j

without the nctessity of full merits briefing by the parties. Sgt ah010 C.F.R. (2.786(b)(4) which recognizes that action on petitions is discretionary with the Commission.
