By letter dated September 10,1999, Charles A. Armontrout, Manager, Licensing and Quality {

Systems, requests that Safety Condition S-4 be deleted from Materials License i SNM-1168. Safety Condition S-4 states: j l

"At no more than 2-year intervals from September 30,1990, the licensee shall update the demonstration sections of the renewal application to reflect the licensee's current operations.

1 The updates to the application shall, as a minimum, include information for the health and safety section of application as required by 10 CFR 70.22(a) through 70.22(f) and 70.22(i) and operational data or environmental releases as required by 10 CFR 70.21. In lieu of an update at the end of the 10-year renewal period, the licensee shall file a renewal application on or ,

before September 30,1999."

i plSCUSSION The demonstration sections were last updated in September,1998. The liense expiration date  ;

is September 30,2000. There is no requirement in 10 CFR that a renewal appe,ation be submitted a year in advance of the expiration date.10 CFR 70.38(a)(1) reads:

Except as provided in paragraph (a)(2) of this section, each specific license expires at the end of the day on the expiration date stated in the license unless the licensee has filed an application for renewal under 70.33 not less than 30 days before the expiration date stated in the existing license (or, for those licenses subject to paragraph (a)(2) of this section,30 days before the deemed expiration date in that paragraph). If an application for renewal has been filed at least 30 days before the expiration date stated in the existing license (or, for ,

those licenses subject to paragraph (a)(2) of this section,30 days before the l deemed expiration date in that paragraph), the existing license expires at the end i of the day on which the Commission makes a final determination to deny the l renewal application or, if the determination states an expiration date, the expiration date stated in the determination.

2 ETherefore, the license will not expire provided a renewal application is imaved before September 1,2000.

The subject letter refers to the proposed rulemaking to amend the 10 CFR Part 70 licensing process (64 FR 41338, July 30,1999). This rulemaking could become a final rule prior to September 1,2000, in that case, the licensees renewal application would need to conform to the requirements of the revised rule, rather than to the current version of 10 CFR Part 70. The cost to the licensee of preparing a renewal application by September 30,1999, and then a second renewal application based on the revised rule, is judged to be an unnecessary expense.

NRC staff has found no discemable safety benefit from obtaining an updated license application by September 30,1990.

( ENVIRONMENTAL REVIEW This change is considered administrative in nature. The staff has determined that the proposed change does not adversely affect public health and safety or the environment and is categorically excluded from the requirement to prepare a site-specific environmental assessment. Therefore, in accordance with 10 CFR 51.22(c)(11), neither an environmental assessment nor an environmental impact statement is warranted for this action CONCLUSION '

Based on the discussion, the staff concludes that Safety Condition S-4 may be deleted from Materials License SNM-1168.

_ The Region 11 and the Operations Branch inspection staff have no objection to this proposed action.
