Dear Ms. Stoeckel:

This is in reference to your June 14,1999 letter to Paul H. Lohaus in response to our June 3, 1999 letter which provided the Nuclear Regulatory Commission's (NRC) comments on Rhode 3

Island's proposed amendments to Rules and Reaulations for the Control of Radiation. The

. proposed regulations in question are in response to the two amendments identified in the enclosed Regulation Assessment Tracking System (RATS) Data Sheet. As a result of our review of yourJune 14,1999 letter, we have the following comments:

1.

Definitions of Occupational Dose and Public Dose (RATS ID 1995-5)

Based on your letter, it is our understanding that Rhode Island will adopt the additional language for the definitions of occupational dose and public dose to make them compatible with NRC regulations during your next round of proposed amendments. We find this approach acceptable and as noted previously, that if your proposed regulations were adopted incorporating the comments and without other significant change, they would meet the compatibility and health and safety categories established in OSP Procedure SA-200.

2.

Manufacture, preparation or transfer for commercial distribution of radioactive drugs containing byproduct materials for medical use (RATS ID 1995-1)

Based on the discussion in your letter and additional discussions with William Dundulis, we understand that the requirements of 10 CFR 32.72(b)(3)-(5) are contained in the rules and regulations of the Rhode Island Board of Pharmacy. Specifically, Section C.8.76(a) of the Rhode Island Rules and Reaulations for the Control of RadiatioD references the implementing regulations (R5-19-PHAR) for the Rhode Island Board of Pharmacy. After further review, we conclude that Rhode Island regulations would meet the compatibility category and withdraw our comment.

3.

Reports to individuals of exceeding dose limits (RATS ID 1995-5)

After review of Section A.5.18 of the Rhode Island Rules and Reaulations for the Control of Radiation, which is a final regulation separate from the draft amendments, we conclude that this section is compatible with 10 CFR 20.2205 and withdraw our comment.
