. Industry Development' of Below Regulatory Concern Rulemaking Petitions The Edison Electric Institute and the Utility Nuclear Waste Management Group plan to file several rulemaking petitions on behalf of the utilities to request that specific waste streams be declared below regulatory concern. The Electric Power Research Institute (EPRI) has instituted a comprehensive program to develop the technical support for the petitions. EPRI established a Technical Advisory Committee to assist in the management of the work. NRC stoff from LLWM, NRR, dnd RES attended a portion of the June 9, 1987 meeting of the committee to update them on NRC activities on below regulatory concern and to be briefed un the EPRI work. The leading candidate waste streams are compacted dry octive waste, waste oil, and contamin6ted soil from both PWRs and BWRs and PWR secondary resins end BWR sandblasting grit. Onsite and offsite burial and incineration, as practicable, are being examined as disposal options. The dry trash represents the largest volume by an order of magnitude and consequently the largest potential savings. Initial estimates are that the utilities could save about 23 million do11ers annually if these streoms were approved for below regulatory concern disposal following the standards and procedures established in NRC's August 29, 1986 Policy Statement and Staff Implementation Plan. The petitions are being developed in parallel and the technical work is expected to take a year to a year and a half.
NRC/00E Physical Security Comparability Measures Members of the Division of Safeguards and Transportation staff and representatives from OGC and RES met with security management representatives of the three major Category I fuel facility licensees (B&W/ Navy, NFS/Erwin, and UNC/ Naval Products) on June 15, 1987. The purpose of the meeting was to discuss implementation of the six NRC/00E physical security comparability measures which were approved and directed by the Commission on June 8, 1987.
Licensees were cooperative but expressed concerns over the very tight schedule for the three security measures which are to be implemented in the near future (nighttime firing qualification, 100% search at protected area, and stationing guards at material access portals). The staff will implement the near-term security measures through issuance of license conditions and directing changes to licensee site security plans. A proposed rule will be prepared to codify these three near-term security measures as well as the three longer-term measures (performance tactical exercises, two protected area fences, and land vehicle barriers). The staff plans to have the proposed rule prepared by October 1987.
Maine Enacts' Legislation Extending EPZ The State of Maine enacted legislation on June 17, 1987, to establish a State Nuclear Safety Program for commercial nuclear power facilities in the State.
The Act establishes, in part, a State Nuclear Safety Onsite Inspector Program, a Nuclear Safety Advisor to the Governor, and an onsite and offsite monitoring system. The Act also establishes a secondary emergency planning zone, which shall extend from the ten-mile EPZ to a designated area to be determined by rule by December 31, 1987, around nuclear power facilities within the State and areas within the State affected by nuclear power plants from adjacent States and provinces.
Indian Point _3_
The Power Authority of the State of New York has inforrred the staff that while conducting the ten year inservice inspection of the Indian Point 3 reactor vessel, three indications have been found in a longitudinal weld.
The indications are from li to 21 inches in length. The Power Authority is investigating.

Palo Verde Unit 3 There has been a resolution-of the Antitrust Dispute between a Palo Verde co-owner (El Paso Electric) and a co-operative (Plains Electric) regarding use of transmission facilities. An agreement was signed last week and a i copy is being forwarded to NRC. Had the dispute not been resolved, it might have impacted the issuance of a full power license.
Shoreham On June 11, 1987, the Commission voted unanimously to deny the LILC0 request for authorization and motion for expeditious consideration to operate Shoreham at 25% of rated power. The Commission believes that-
-to consider the request would further complicate the already protracted proceedings on EP issues. Also, the Commissien found that nothing in the request indicates that there is an avenue for the approval of the request before the summer peak for power demand.
Seabrook, Unit No. 1 On June 11, 1987, the Commission by a 3 (Zech, Bernthal, Asselstine) to 2-(Carr, Roberts) vote denied the motion of Public Service Company of New Hampshire (PSNH) to vacate the Commission's April 9,1987 decision (CLI-87-02) on ALAB-853 as moot and to lift the stay on low power operations at Seabrook. (The single issue on review of ALAB-853 was whether a low power license should be issued absent any filing of an emergency plan (EP) for that part of the emergency planning zone that lies in Massachusetts.)
The issue that governed the June 11, 1987 Commission decision is whether PSNH's April 8,1987 filing of a " utility EP" for Seabrook satisfied the Commission's intent in requiring the filing of a state or local govern-mental or utility EP.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending' June 19, 1987 Lost or Stolen Troxler Gauge Region II notified NMSS at approximately 3:30 p.m., June 16, 1987 NRC licensee, ATEC Associates of Virginia, reported that one of their Troxler soil density gauges was missing and presumed stolen. The gauge was left unattended beside a vehicle overnight the evening of June 12, 1987. The vehicle was ,
parked at a job site near Oakton, Virginia, where Highway 123 intersects I-66, i The' gauge contains eight millicuries of cesium-137, 40 millicuries of americium-241 and beryllium. The gauge itself measures about 9 inches' wide,
.and 18 inches long with a source rod handle sticking up some 24 inches above the top. The source rod was not locked in place. The dose rate to an individual moving the source rod from its gauge housing would be approximately.
. 25 rem per hour at one centimeter from the tip of the extended source rod.
Shielded, the maximum dose rate is about 15 millirem per hour.
The following actions have been taken or are being taken: (a) Licensee has.
notified the Sheriff of Fairfox County, Virginia and the NRC notified the Commonwealth of Virginia; (b) Region II has issued a news release and has briefed the Commission staffers; (c) the Chairman was briefed by Hugh' Thompson and Vandy_ Miller at approximately 6:30 p.m., June 16, 1987; and, (d) Region II dispatched-an inspector to the licensee site at 12:30 p.m., June 17, 1987.
West Valley Demonstration Project I The West Valley Demonstration Project has completed eight penetrations in the top of the High-Level Waste Tank 8D-2. These penetrations are for the {
installation of process pumps and sludge level probing equipment. The 1 permanent ventilation system is being used in conjunction with a confinement I barrier to prevent the release of any radioactivity during installation of this equipment.

Qudlity Assurence Audit of DOE HLW Repository Program The NRC staff conducted its first quality assurance audit of the DOE high-level waste repository program during the week of June 8, 1987. The minerology/ petrology investigations being conducted at the Los Alamos National i Laborotory (LANL) for the NNWSI site were audited by a team of both technical and quality assurance staff which examined the quality systems and technical work at the laboratory. One of the main purposes of the audit was to enable DOE to understand first hand the expectations of the NRC staff in its review of the repository QA programs. Although DOE hed believed the program to meet !
the Commission's quality assurance requirements, the staff identified severol l deficient areas including training programs, the audit / surveillance program i within LANL, and certifications of personnel which, left uncorrected could affect the licensability of the repository. The quality of the technical work i was found to be high. Additional audits of other program areas are being scheduled. ;

NRC/ DOE Physical Security Comparability Measures Members of the Division of Safeguards and Transportation staff and representatives from OGC and RES met with security management representatives of the three major Category I fuel facility licensees (B&W/ Navy, NFS/Erwin, ,
and UNC/ Naval-Products) on June 15, 1987. The purpose of the meeting was to 1 discuss implementation of the six NRC/ DOE physical security comparability measures'which were approved _and directed by the Commission on June 8, 1987.
Licensees were cooperative but expressed concerns over the very tight schedule
'for the three security measures which are to be implemented in the near future
. (nighttime firing qualification,100% search at protected area, and stationing guards at material access portals). The staff will iniplement the near-term .
security measures:through issuance of license conditions and directing changes l to licensee site security plans. A proposed rule will be prepared to codify these three near-term security measures as well as the three longer-term measures (performance tactical exercises, two protected area. fences, and land i vehicle barriers). The staff ~ plans to have the proposed rule prepared by October 1987.
US/IAEA International Safeguards Meeting NMSS staff is participating in a meeting of the US/IAEA Working Group on Accounting and Reporting in Oak Ridge, Tennessee. Harold Denton and Donald Nussbaumer visited the Arkansas Health Department on June 16, 1987 and were briefed on the Agreement State program. They also l discussed low-level waste issues with representatives of_the Governor's office.
Maine Enacts' Legislation Extending EPZ The State of Maine enacted legislation on June 17, 1987, to establish a State Nuclear Safety Program for commercial nuclear power facilities in the State.
The Act establishes, in part, a State Nuclear Safety Onsite Inspector Program, a Nuclear Safety Advier to tne Governor, and an onsite and offsite monitoring system. The Act also establishes a secondary emergency planning zone, which shall extend from the ten-mile EPZ to a designated area to be determined by rule by December 31, 1987, around nuclear power facilities within the State and areas within the State affected by nuclear power plants from adjacent States and provinces.
Massachusetts and Reportable Events The Commonwealth of Massachusetts Civil Defense Agency initiated arrangements with Pilgrim, Yankee Rowe and Vermont Yankee to be notified when an event, which is reportable under 10 CFP 50.72 occurs. The Civil Defense Agency also j made arrangements to contact the NRC Region I at 10:00 a.m. each werkday to {
verify the licensee reports.
Interagency Response Video Sheldon Schwartz, Deputy Director, SLITP met with representative of FEMA, DOE, Commonwealth Edison Company, State of Illinois and Argonne National Labs in June 15, 1987 to discuss final assignments for tapeing the FFE. Key response locations in Illinois and Wisconsin will be video taped on all three days of the'FFE to caputure major discussion and decisions. Taping of the NRC Operations Center was accomplished during the Dry Run and is, therefore, not l on the shooting schedule for the FFE.

On June 9.1987, the Commission was briefed on the status of the performance indicator (PI) program including SECY-87-117, Coordination Plan for NRC/INPO i Use of Performance Indicators. 1 The interoffice task group, with members from AE00, NRR, RES and all five Regions, met on' June 11-12, 1987 to review the status of the PI development. projects. In' the area of direct risk-based PIs, a risk-weighting program for some existing PIs ,
is.close to being complete. A trial application of the program is in progress.
.In the next phase, LC0 data-will be collected'from Surry and Limerick for developing-indicators of safety system unavailability. In the area of programmatic PIs, the cause codes are close to being finalized. Other areas continue to be explored.
Incident Response Branch During the week of June 15, 1987, the Incident Response Branch (IRB) staff was engaged in final- preparations for the Federal Field Exercise (FFE). These efforts included contacts with'the states of Illinois and Wisconsin and other key organizations to ensure effective coordination during the exercise.
On June 17, 1987, . IRB cnd the .Information Resources Management (IRM) staff installed software and conducted training for Region III on the use of their response computer systems (base and site team) with respect to their capabilities to send electronic mail, to access meteorological data, and to access NRC head-quarters dose n.odels and. DOE dose models. The IRB and IRM staff also installed end tested the base team ccyuter system, which provides a Zion temporary data link to allow direct access to the Zion plant data.
On June 17, 1987, IRB staff conducted a tour and briefing of the Operations Center to three representatives of the Swedish government who have come to the United States to attend the.FFE-2.
-On June 18, 1987, an-IRB staff member, along with a member of the Office of-Governmental and Public Affairs, testified at the Atomic Safety Licensing Board
-(ASLB) hearing on emergency planning in Hauppage, New York on the question of whether the' Shoreham emergency preparedness exercise was a " full-participation" exercise.
Technical Training Center The Standardized. Nuclear Unit Power Plant System-1 (SNUPPS) Westinghouse simulator is being disassembled at Zion, Illinois and will be shipped to the Technical Training Center (TTC) during the week of June 16, 1987. It is anticipated that the simulator will be moved into the TTC building on June 22-23, 1987 and can be 1 operational by July 4, 1987.

The action was based on (1) the falsification of daily constancy checks of the dose calibration by the licensee's two technologists, and (2) the falsification of records of Radiation Safety Committee meetings by the Radiation Safety Officer (RS0) over the past 15 years. The Order Modifying License orders (1) the removal of the RS0, (2) the performance of monthly independent audits by an independent party of the licensee's radiation safety program, and (3) a review of the Radiation Safety Program by the new RSO, correction of deficiencies identified, and certification by the licensee to the NRC that the Nuclear Medicine Program is being operated safely and in accordance with NRC requirements.
