Dear Mr. Anderson:
By Northem States Power Company's (NSP's) application dated March 13,1998, General Electric Company's (GE's) affidavit dated January 26,1998, executed by Glen A. Watford for Exhibit D (GE Nuclear Energy letter dated January 26,1996, "Monticello Cycle 19 SLMCPR
' Calculation"), and Siemens Power Corporation's (SPC's) affidavit dated November 12.1997, executed by H. D. Curet for Exhibit F (SPC letter dated October 29,1997, "MCPR Safety Limit for SPC QFA's in Monticello Cycle 19"), NSP submitted a proposed license amendment and requeste; that Exhibits D and F be withheld from public disclosure pursuant to 10 CFR 2.790, GE stabd that the information submitted in Exhibit D should be considered exempt from mandatory public disclosure for the following reasons:

The information discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by GE's competitors without license from GE j
constitutes a competitive economic advantage over other companies.-

The information, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, l
assurance of quality, or licensing of a similar product.

The information contains details of GE's Safety Limit MCPR analysis and the corresponding results which GE has applied to Monticello's actual core design with GE's

i fuel. The development of the methods used in these analyses, along with the testing, development, and approval of the supporting critical power correlation was achieved at a significant cost, on the order of several million dollars, to GE.
SPC stated that the information submitted in Exhibit F should be considered exempt from mandatory public disclosure for the following reasons:

The information reveals certain distinguishing aspects of SPC licensing methodology which secure competitive advantage to SPC for fuel design optimization and marketability, and includes information utilized by SPC in its business which affords SPC an opportunity to obtain a competitive advantage over its competitors who do not or may not know or use the information.

The information provides insight into SPC licensing methodology developed by SPC.
SPC has invested significant resources in developing the methodology as well as the strategy for this application. Assuming a competitor had available the same background information data and incentives as SPC, the competitor might, at a minimum, develop the information for the same expenditure of manpower and money as SPC.
We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted
. information sought to be withheld contains proprietary commercial information.
Therefore, Exhibits D and F, marked as proprietary, will be withheld from public disclosure j
pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. if the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.' You also should understand that the NRC may have cause to review
'this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information, in all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any,public disclosure.
