SUBJECT:
3M LETTER DATED FEBRUARY 27, 1991, CONCERNING THE MODEL 4F6M and 4F6H 1
Based on the letter and its enclosed drawings it appears that 3M was not distributing these sources in accordance with the registration sheet.
The model 4F6H has been registered inactive since 1964, but 3M has continued to sell and manufacture it.
Additionally, The model 4F6H has never contained the labeling information as originally submitted by 3M.
Ideally one would seek to take enforcement action against 3M for not complaining with the terms and conditions of the registration certificate and their commitments Given that 3M is discontinuing all source production and sales, that the enforcement of registration certificate has not been fully evaluated and that 3M is currently under enforcement action for the same type of wrong doing.
I elected not do initiate any action since the outcome of such an action would likely be to restrict sales and 3M has already done this.
