NOTICE OF VIOLATION Vermont Yankee Nuclear Power Corporation Docket No. 50-271 Vermont Yankee License No. DPR-28 During the NRC inspection conducted from December 7,1997 - January 24,1998, a violation of NRC requirements was ide.tifid. In accordance with the " General Statement of Pohey and Procedure for NRC Enforcement Actions," NUREG-1600,the violation is listed below: ,
Vermont Yannee Technical Specification 6.5.A "P6nt Operating Procedures," states that detailed written procedures shall be prepared, approved and adhared to including fire protection program implementing procedures. The Vermont Yankee Safe Shutdown Capability Analysis, revision 5, dated November 19,1996, identifies the High Pressure Coolant injection (HPCI) system as a s?fa shutdown ;ystem, and indicates that the wall that separates the HPCI room from the torus room shall be maintained as a fire barrier in !
eccordance with Appendix A of Branch Technical Position APCSB 9.5-1, " Guidelines for Fire Protection for Nuclear Power Plants." ,
Contrary tc me above, the HPCI room Appendix A fire barrier was found to be inoperable on January 13,1997,in that the closure mechanism for the associated automatic self-closing fire door was inoperable and the door would not close. I This is a Severity Level IV violation (Supplement 1).
Pursuant to the provisions of 10 CFR 2.201, Vermont Yankee Nuclear Power Corporation is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a i copy to the Regional Administrator, Region 1, and a copy to the NRC Resident inspector at !
the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a
" Reply to a Notice of Violation" and should include: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
