REQUEST TO WITHHOLD PROPRIETARY INF0PMATION FROM PUBLIC DISCLOSURE -

SUPPLY SYSTEM NUCLEAR PROJECT N0. 1 (WNP-1)

By letter dated May 19, 1986, you submitted an evaluation of electrical cable tray and conduit system seismic damping for WNP-1 and requested that Figure A,

" Acceleration Input - Conduit Damping," Figure B, " Comparison of Multi-Tiered Cable Tray Systems," and Figure C, " Relationship of Connection Stiffness to Damping," of Enclosure 1 to your letter, be withheld from public disclosure under the provisions of 10 CFR 2.790. Additionally, you provided non-proprietary copies of Enclosure I which have Figures A, B, and C removed. Affidavits executed by officials of the Supply System and Bechtel Power Corporation (Bechtel) accompanied your submittal.

In his affidavit, Mr. Charles W. Lacey, Vice President, Bechtel, stated that Figures A, B, and C are Bechtel documents and are Bechtel's procedure describing Bechtel's means and methods for performing calculations relating to the design and construction of nuclear power plants and should be exempt from mandatory public disclosure because:

(1) the figures contain Bechtel trade secrets, proprietary and confidential discoveries, information, data, and records of a type customarily held in confidence by Bechtel, (2) the information was transmitted to the Commission in. confidence, (3) the information is not available in public sources, and (4) public disclosure of the information is likely to cause substantial harm to Bechtel's competitive position in that the information represents unique approaches and capabilities for resolving complex safety, technical, commercial, and industry issues; substantial and significant effort and money have been expended to maintain these capabilities; and others would have difficulty in properly acquiring or duplicating this information.

We have reviewed your application and on the basis of Bechtel's statements, we have determined that Figures A, B, and C of Enclosure 1 to your May 19, 1986 letter contain trade secrets or proprietary commercial information. We will, 8611070186 861104 PDR ADOCK 05000460 A

Withholding from public. inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents..If the need arises, we will send copies of this information to.our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change such that the information could then be made available for public inspection, you should promptly notify us. You should also understand that we may have cause'to review this determination in the future, such as, if the scope of a Freedom of Information Act request includes your information.

In all review situations, if we make a determination adverse to the above, you will be notified in advance of any public disclosure.
