filed two requests pursuant to the Freedom of Information Act (10 CFR 9,
Subpart A).-
The request designated as FOIA-86-151 requested Commission records as follows:

From the Chron Files of Mr. Hans Schier'ing from 4
September 1,
1981, through December 31, 1983, all records concerning in any way the Diablo Canyon Nuclear Power Plant, Units 1 and/or 2.

From the Reading Files of Mr. Hans Schierling from September 1, 1981, through December 31, 1983, all records concerning in any way the Diablo Canyon Nuclear Power Plant, Units 1 and/or 2.
The request designated as FOIA-86-197 requested Commission records as follows:

On August 28, 1986, almost six months later, I received a telephone call indicating that five boxes of ma te rial had been identified as being potentially responsive to these requests, and that the material in these boxes would be reviewed by the Staff and
- released, a
box at a
- time, at approximately one week intervals.
The first batch of documents was ultimately released by letter dated September 5, 1986.

. Additional partial responses.to these requests were made by-the Office of Administration on September 8,
16, 23, 30, and October 3 and 9, 1986.-
I called the Office of Administration on December 5,
1986, inquiring about the status of the response to-these requests.
I was informed that.the partial responses to date represented _ two - of the five boxes of material,.and that there remained three boxes of material to be reviewed for release.
In-addition, I
recently received a
letter dated December 5, 1986, providing four additional documents.
I sincerely believe that the NRC Staff has had far more than I
enough time to respond to these requests.
In short, the Staff's response to these requests carries all the marks of the 'Staf f simply dragging its heels.
As a result, I find myself in the unfortunate position of being forced to file an Appeal for Lack'of Response to obtain the not-exactly-expeditious release of the remainder of the records-q identified by the Staff as being potentially responsive to my requests.
I have concluded, as a-result of the Staff's dilatory
- response, my requests FOIA-86-151 and FOIA-86-197 have been ef fectively denied, and I hereby appeal this de facto decision pursuant to 10 CFR 9.11.
The prompt release of the remainder of the records subject to FOIA-86-151 and FOIA-86-197 is therefore requeste.d.
I await your response within the twenty days from the date of the receipt of this appeal as provided in 10 CFR 9.11(b).
