It has just come to our attention that in the enclosed proxy statement Texas Utilities represents, apparently with reference to the Cresap prudency audit which is the subject of our Motion to Compel, the following:

Questions of management prudency and responsibility for cost increases are already under review.

An independent consultant is performing a complete analysis of management prudency.

The causes of deficiencies in the plant's construction are being assessed in the ongoing reinspection and corrective action program.

Findings in these areas will be presented in one or more public forums.

Therefore, additional reviews would be redundant and unnecessarily costly.

It is evident from this statement that the prudency audit is still going on and that its results will be made publicly available.

We believe that this contradicts Applicants' assertions in their Opposition to our Motion to Compel that the prudency audit has been halted and that the information therein will not necessarily be made public.
