Dear Ms. Garde:
This is in response to your letter dated October 29, 1986, in which you appealed Mr. Grimsley's letter dated October 15, 1986, which denied-in-part your Freedom of Information Act (F0IA) request for all documents concerning the reports listed in Board Notification 84-149 and documents relating to the release of the reports. You specifically appealed the denial of the records identified on the enclosed appendix.
Acting on your appeal, I have carefully reviewed the records in this case and have determined that some of the previously withheld information can now be released.
Therefore, your appeal i; partially granted and partially denied.
Portions of the records identified on the appendix will continue to be withheldfrompublicdisclosurepursuanttoExemptions(6),(7)(C)and (7)(D) of the F0IA (5 U.S.C.*552(b)(6), (7)(C) and (7)(D)) and 10 CFR 9.5(a)(6), (7)(C) and (7)(D) of the Comission's regulations. The nonexempt portions of the records are enclosed.
The portions of the records that are withheld consist of names and other identifying information the disclosure of which would cause a clearly unwarranteo invasion of personal privacy and also disclose the identities of confidential sources.
I am unable to identify any legitimate public interest in the disclosure of this information which outweighs the individuals' privacy interests.
This is a final agency action. As set forth in the F0IA (5 U.S.C.
552(b)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside, have your principal place of business, or in the District of Columbia.
