Ref: CPCo Letter dated April 16, 1987 from Frederick W. Buckman to USNRC, Attn: Document Control Desk re above License The referenced letter requested NRC consent, or in the alternative a disclaimer of jurisdiction, under Section 184 of the Atomic Energy Act end 10 CFR 5 50.80, with respect to the effect on the above-described licenses of a proposed restructuring plan by which Consumers Power Company will become a wholly-owned subsidiary of a new holding company, CMS Energy Corporation. A similar request was made with respect to certain byproduct materials licenses by letter of April 29, 1987 to Region III.
This is to advise you that Consumers Power's shareholders, at their annual meeting held today, voted to approve the restructuring plan. The merger by which the restructuring is to be accomplished is scheduled to take place on May 22, 1987. If there is any likelihood that you will not be able to take the requested action before that date, please let us know promptly.
