- 27. May 1986 Note to Bruce Borson, Regional Counsel Region III CHEMICAL INDUSTRIAL SERVICES (TRANSFER OF MATERIAL BY TRUSTEE IN BANUROPTCY HELD UNDER EXPIRED NRC LICENSE)
I have no objection to the approach outlined in your letter to the trustee in bankruptcy for Chemical Industrial Services to handling tran=fer of the material held f ormerly under the authority of a now expired NRC specific license for a gas chromatograph, and I concur in your letter.
However, I understand that the region has for action an application from the owner of Chemical Industri al Services for a new licenso and that the owner is likely to bid on the gas chromatograph at the upcoming auc tipn sale. j,T,he award of a,new license to the old licenswe's owner may be iepruddnt given his past financial problems, though I understano that.t'be Commissi'orf'may not have set specific requirement's for financial qualificati'ons in this area as yet.
I also under s tand,*/:however, that the licensee ignored a number of inquirtes from the NRC concer'ning the status of his activities and his intentions to rid himself of the material.
Now that he wants something from the Commission again, he seems a bit more cooperative.
Under the circunstances, it appears that there is an adequate basis to deny the new license in view of his past conduct in dealing with the Commission.
Whsle the material at issue may not pose a substantial safety hazard.
there does nnt seem to be a compelling reason to perpetuate the owner as; an NHC licensee.

July 31, 1984 2616 C1ifford Detroit, MI 48201 Gentlemen:
On August 29, 1984 A Notice of Violation letter was sent to you stating that your license expired on July 31, 1984.
The letter requested you to submit the Form NRC-313 (Application for Materials License) IMMEDIATELY if you wanted to continue your program.
As of this date we have not received a response from you.
Your continued use and/or possession of NRC Licensed Material without a specific license is a violation of 10 CFR 30.3 and the Atomic Energy Act of 1954 as amended.
If you continue to willfully use and/or possess radioactive material without a valid NRC license, this is the basis for NRC to take f.scalated enforcement actions, which may include a civil penalty and/or crirriril actions.
Accordingly you must take the following acticos immediately:
(1) Divest yourself of the material in a lawful manner; (2) Submit a copy of form NRC-314 (Certificate of Disposition of Materials) or 1RC-313 (Application for Materials License); and (3) Complete Items 1 and 2 within 14 days from the date of this letter, so that we can close out our records far your expired license.
If you have any questions please contact Ms. Rose Pankratz at 312/790-5735, otherwise an NRC inspector will inspect your facility in the near future to discuss this serious violation of NRC regulations.
