Subject:
Inquiry No. 99990001/86-14 This refers to a telephone inquiry by Mr. Thomas K. Thompson of this office with Mr. Omer Gendron of your staff on November 5,1986. This inquiry concerns unauthorized distribution of byproduct material in the form of gas chromato-graph detector cells containing Ni-63 and H-3.
Information provided by Mr. Gendron indicates that you have redistributed gas chromatographs containing byproduct material for several years. NRC requires such redistribution to be authorized in an NRC License.
We have sent Mr. Gendron of your staff an application form and pertinent regula-tions to expedite your obtaining a license.
Important information that NRC will need for your company to obtain such a lic-ense is listed as follows:
1)
What isotopes, detector cell models, item quantity and total quantity of each isotope do you desire to possess?
2)
What gas chromatograph units will be matched with which detector cell models?
3)
How do you assemble completed gas chromatographs and assure that you do not remove or alter any required labels or instructions?
4)
What is your method to assure these devices are distributed with instruct-ions and labels as required by 10 CFR 32.51 and 32.51(a)?
5)
State that you will maintain transfer records and submit a quarterly trans-fer report to NRC and Agreement States in accordance with 10 CFR Section 32.52 From our telephone discussion, it is NRC's understanding:
1)
That you will immediately place any byproduct material that you possess in storage until you receive an NRC license authorizing your re-distribut-ion activities.

We further understand that you presently possess only 1 gas chromatograph detector cell and that you will provide us a list of customers to whom you have previously sent gas chromatographs containing byproduct material.
Please confirm our understanding in writing.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the Public Document Room.
