REPORT NO. 86-01 AND NOTICE OF VIOLATION
-As a res' ult of inspection activities conducted by NRC during August and September 1986, it has been determined that activities conducted by your agency during June and July 1986, resulted in a violation of NRC requirements. This violation was discussed with Mr. J. Smith, Acting Chief, Personal Property Sales Center, Franconia, Virginia, and Mr. L. Franklin of our staff on November 6, 1986.
The inspection activities indicated that GSA at Franconia, Virginia, received from the Federal Aviation Administration on June 26, 1986, a Troxler moisture density gauge, Serial No. 4029. The moisture density gauge contains byproduct material.
GSA, in turn, sold the moisture density gauge to a non-licensee on July 24, 1986.
10 CFR 30.3 requires in part that no person shall receive, acquire, own, or possess byproduct material except as authorized in a specific license.
The violation, references to pertinent requirements, and elements to be included in your response are described in the enclosed Notice of Violation.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations; a copy of this letter and its enclosure will be placed in the NRC Public Document Room.
The responses directed by this letter and its enclosure are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
