SUBJECT:
REQUEST FOR WITHHOLDING FROM PUBLIC DISCLOSURE In a letter dated May 21, 1987, Northeast Nuclear Energy Company (NNECO) submitted the proposed revisions to the Technical Specifications (TS) for-Millstone Unit i for Reload 11 Cycle 12.
In addition to the proposed changes to the TS, this letter contained an analysis by General Electric (Attachment 3, NEDE-24085-1-P) which supports the proposed TS changes. This. analysis was accompanied by an affidavit from the General Electric Company requesting that i be withheld from public disclosure pursuant to 10 CFR 2.790(b).
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

It contains details concerning current General Electric fuel designs which were developed at considerable expense l
and which are not available to other parties.

The information has consistently been held in confidence i
by General Electric and is not available in public sources.
3.
Public disclosure is likely to cause substantial harm to the competitive position of the General Electric I
Company and deprive or reduce the availability of project
- naking opportunities because it would provide other parties, including competitors, with valuable information regarding current General Electric fuel designs which were obtained at L
considerable cost; e.g., man-power, computer, and manufacturing resources expended to develop the current fuel designs.
We have reviewed the application and the material based on the requirements and criteria of 10 CFR 2.790 and, on the basis of the information in the affidavit, have determined that the submitted information sought to be with-i held contains trade secrets or proprietary comercial information.

withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act, as amended.
We, therefore, approve your request for withholding pursuant to 10 CFR 2.790 l
and are withholding the aforementioned Attachment 3 to NNEC0's May 21, 1987 letter from public inspection as proprietary.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, such as if the scope of a Freedom of Information Act request includes your information.
In all review situations, if the NRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
