Dear Mr. Chairman:

On November 20, 1986 I wrote to you asking that (1) the NRC cease all work associated with Public Service of New Hampshire's

" explorations" regarding filing for an exemption f rom the 1

Commission's emergency planning regulations, and (2) that the NRC terminate its contract with Brookhaven to review PSNH technical studies intended to support such an exemption request,

,! particularly sisce no formal request of any kind has been filed by PSNH. I asked you to respond to my letter by December 1,1986.

To date, I have received in response only a letter f rom Carl

! Kammerer informing me that the Commission "should be able to respond to [my) letter on or before December 11, 1986."

4 Speaking frankly, I cannot understand why it should take the NRC three weeks to respond to what is in essence a simple request.

l A response to my letter requires no search of files, or any compilation of documents or data. The fact that the NRC has indicated that it intends to take three weeks to respond can only l

' raise questions as tc whether you purposefully are attempting to delay a response for some reason or whether the agency's

, management practices should be reviewed with regard to their efficiency.

Yesterday my staff received the attached letter from PSNH to the NRC indicating that the utility intends to file formally for some kind of relief f rom the NRC's emergency planning regulations before the end of the year, and asking the NRC to further expedite their review of PSNH related technical studies.

As I noted in my letter of November 20, the issues surrounding emergency planning at Seabrook and the legitimate i rights of the Commonwealth of Massachusetts and six local

, communities to participate fully in the licensing process are

matters of the most profound importance to all parties concerned

! about nuclear safety and the legitimate interests of the States i
