Dear Dr. Murley:

The purpose of my letter is to advise you of NHY's emergency planning activities since our meeting of May 7,1987 and to request a meeting between our respective staf fs.

First of all, in regards to the NHY petition to reduce the EPZ, I would like to inform you that NHY has no plans at this time to resubmit such a request. NHY will, however, continue to respond to past ques-tions of the Staff as we had previously committed (i.e., at meetings or

in correspondence).

In regards to emergency planning for that portion of the 10 mile EPZ within the Commonwealth of Massachusetts, NHY is in the process of finalizing a set of interim compensatory plans and procedures. These plans and procedures will supplement the detailed emergency response plan previously submitted [ Reference (b)]. It should be noted that it is our position that the plan previously submitted, in combination with  !

the State of New Hampshire emergency response capabilities, demonstrates  !

, that an extensive basis and framework exists by which the health and 1 safety of the public will be protected (Reference (c)].

Murley Page 2 New Hampshire Yankee is continuing in its efforts to obtain full or partial cooperation of the Commonwealth in the planning process. To date, however, we have been unsuccessful in persuading Massachusetts of the benefits of participation in emergency planning.

Due to the continuing noncooperation by the Commonwealth, we fully recognize that NHY will have to take certain compensatory measures in order to comply with your 10 mile EPZ requirements for full power licensure. For many months, NHY has studied the emergency planning options available to us and as a result is finalizing a set of interim compensating plans and procedures that supplement the Massachusetts plan.

This also provides further clarification as to how emergency planning can be implemented for the Massachusetts portion of the EPZ should the Common-wealth's refusal to cooperate persist.

We also recognize that the NRC's emergency planning regulations are qualitative and general in nature. This, unfortunately, can lead to differing interpretations of the same rule by different organiza-tions. One recent example of this concerns us because of the poten-tially significant impact on the Seabrook licensing process. On June 4,1987, the Federal Emergency Management Agency (FEMA) issued its position on the contentions to be litigated during the upcoming hearings on the State of NH Emergency Response Plans. From our review, it appears that the FEMA positions on the evacuation / sheltering of the beach popula-tion is at odds with our interpretation of the intent of your rules.

Before we finalize the submittal, it is imperative that we confirm our understanding and interpretation of the emergency planning requirements for full power operation. As such, I request that a meeting be scheduled between our respective staff s, at the NRC's earliest convenience, to review the technical issues of concern to us. This meeting would also serve as an opportunity for NHY to present its schedule for future submittals to allow you to efficiently allocate your resources.
