Dear Mr. Mroczka:

We are in receipt of your letter dated May 7,1987 on the subject of fire protection for Millstone Unit 2.

We share your concern that the complexity of the issue may have led to a misunderstanding regarding the status of your compliance with the reouf rements of 10 CFR 50.48 and Appendix R to 10 CFP Part 50.

Based upon your letter of May 7, 1987, and our subsequent conversation with Mr. R. Kacich of your staff, we understand the following with regard to compliance with the fire protection requirements:

Those plant modifications not requiring a plant shutdown, necessary to meet our fire protection requirements, were completed prior to January 15, 1987.

In addition, those modifications requiring a plant shutdown will be completed during the next refueling outage which is schedu'.d to begin during January 1988.

The NRC staff issued its fire prote'ction safety evaluation (SE) on April 15, 1986. Your revised approach to fire protection rendered many of the SE requirements and exemptions, unnecessary. This was the cause of much of our misunderstanding concerning your compliance with our fire protection j

requirements for Millstone Unit 2.

In the event that the staff does not agree with certain elements of your fire protection analysis described in your April 16, 1987 submittal, your submittal cannot then provide a basis for NRC issuance of an exemption.

Should you need an exemption from rule, you should provide an additional submittal, specifically describing the nature of the exemption and providing an analysis including the information required under 10 CFR 50.12

At the present time, we expect to complete our evaluation of your April 16, 1987 submittal by July 10, 1987.
