Subject:

PROPOSED EMERGENCY PREPAREDNESS RULEMAKING Prior History: SECY-86-254

Purpose:

To obtain Commission approval of a notice of proposed rulemaking Discussion: We advised the Commission in SECY-86-254 that we would prepare a proposed rule to amend the requirement for a full participation emergency preparedness exercise within one year prior to issuance of an operating license. The Commission in a September 19, 1986 staff requirements memorandum agreed that such a proposed rule should be submitted to the commission for consideration.

Attached is a self-explanatory proposed rule which changes the requirement for a full participation exercise to within two years of issuance of an operating license. Staff is seeking formal FEMA concurrence in this proposed rule, and has requested FEMA to respond by October 10. To expedite consideration of this rulemaking, we are providing the draft proposed rule to the Commission before receiving a response from FEMA. We will provide the Commission with any FEMA comments upon receipt.

Proposed rule Commissioners' comments or consent should be provided directly to the Office of the Secretary by c.o.b. Tuesday, October 21, 1986.

Commission Staff Office comments, if any, should be submitted to the Commissioners NLT Tuesday,-October 14, 1986, with an information copy to the office of the Secretary. If the paper is of such a nature that it requires additional. time for analytical i review and comment, the Commissioners and the Secretariat should be apprised of when comments may be expected.
