APPENDIX A NOTICE OF VIOLATION Public Service Electric & Gas Company Docket No. 50-354 Hope Creek Generating Station License No. NPF-57 During an NRC inspection conducted on October 27-31, 1986, a violation of NRC requirements was identified. The violation involved the failure to comply with condition C(10) of your license. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy 1986), the violation is listed below:

License No. NPF-57, Condition C(10), requires that " changes to the initial startup test program described in Section 14 of the FSAR made in accordance with the provisions of 10 CFR 50.59 shall be reported in accordance with 50.59(b) within one month of such change."

10 CFR 50.59(b) requires, in part, that records of changes "shall include a written safety evaluation which provides the bases for the determination that the change does not involve an unreviewed safety question."

Contrary to the above, on August 22, 1986, the licensee changed the initial startup test program described in Section 14 of the FSAR by performing test TE-SU.SV-281, Shutdown from Outside the Control Room, in Test Condition 1 without preparing a written safety evaluation. Section 14 of the FSAR 'escribes test TE-SU.SV-281 as being performed in Test Condition 2. In addition, the licensee failed to report this change within one month.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Hope Creek Generating Station is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the reasons for the vio'.a ti on if admitted, (2) the corrective steps which have been taken and the results achieved; (3) corrective steps which will be taken to avoid further violations; and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
