9 DUKE POWER COMPANY RESPONSE TO VIOLATION 413/86-40-02 and 414/86-43-02 10 CFR 50.54(q) states that a nuclear power reactor licensee shall follow and maintain in effect an emergency plan which meets the Standards in 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.

Section N.2.e of the licensee's emergency plan states that Health Physics drills shall be conducted semi-annually which involve the Post Accident Liquid Sampling System and the Post Accident Containment Air Sampling System operation to collect simulated elevated airborne and liquid samples and direct radiation measurements in the environment.

Contrary to the above, during the calendar year 1985, only one of the required two Health Physica drills involving the collection of simulated elevated airborne samples from the Post Accident Containment Air Sampling System was conducted.

Response

(1) Admission or Denial of Violation Duke Power company admits the violation.

(2) Reasons For Violation If Admitted The persons responsible for-conducting and scheduling the drills did not schedule the drill properly to ensure personnel were available for the drill.

(3) Corrective Actions Taken and Results Achieved (A) The Employee Training and Qualification System (ETQS)is now implemented which will ensure personnel are periodically qualified through training and drills.

(B) Scheduling of Health Physics (HP) emergency plan training / drills for Health Physics personnel are now the responsibility of HP ETQS personnel, within the Training Department.

(C) The training / drills are now given to a specific group within HP who have training weeks scheduled in their work schedule (5 classes per year are given).

(4) Corrective Actions To Be Taken To Avoid Further Violation Actions taken in section 3 above ensure avoidance of further violations.

(5) Date of Full Compliance Duke Power Company is now in full compliance.
