ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 55-369 and 50-370 McGuire License Nos. NPF-9 and NPF-17 During the Nuclear Regulatory Commission (NRC) inspection conducted on October 20-24, 1986, violations of NRC requirements were identified. The violations involved failure to follow radiation protection procedures and failure to adhere to Department of Transportation (D0T) requirements for transportation of radioactive materials. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the violations are listed below:

A.- 10 CFR 71.5(a) requires each licensee who transports licensed material outside of the confines of its plant or other place of use, or who delivers licensed material to a carrier for transport, to comply with the applicable requirements of the regulations appropriate to the mode of transport of the Department of Transportation in 49 CFR Parts 170 through 189.

49 CFR 173.425(b)(1) requires that packaged shipments of low specific activity (LSA) material consigned as exclusive use be packaged in a 00T Specification 7A Type A package or a strong, tight package so that there will be no leakage of radioactive material under conditions normally incident to transportation.

Contrary to the above, the licensee failed to package a shipment of LSA radioactive material in a DOT Specification 7A Type A package or a strong, tight package in that on August 12, 1986, Radioactive Waste Shipment No. 0886-184-A arrived at the burial facility with a hole in one B-25 metal box.

B. Technical Specification 6.11 states that procedures for personnel radiation ,

protection shall be prepared consistent with the requirements of 10 CFR 20 l and shall be approved, maintained and adhered to for all operations '

paragraph 3.1 states that all air samplers in use shall be calibrated at l 1 east every three months.

' Duke Power Company Docket Nos. 50-369 and 50-370 McGuire 2 License Nos. NPF-9 and NPF-17 sampler over the B-25 box compactor in the Waste Shipping Area had not been calibrated since June 12, 1986, and had been used to collect air samples I in that area for determining compliance with regulatory limits and assessing personnel exposures.

This is a Severity Level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, Duke Power is hereby recuired to submit to this Office within 30 days of the date of the letter transm'tting this Notice a written statement or explanation in reply including (for each violation): (1) admission or denial of the violation, (2) the reason for the violation if rdmitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
