Dear Mr. Devine:

This is in response to your letter dated March 4, 1986, in which you requested, pursuant to the Freedom of Information Act (FOIA), records related to the Office of Inspector and Auditor (01A) investigation and audit into charges that the NRC staff responded improperly to allegations by "whistleblowers" at the Diablo Canyon plant.

As you were advised during the week of September 15, 1986, the documents listed on enclosed Appendix A are responsive to your request and are already available in the Nuclear Regulatory Commission's (NRC) Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555. You may find documents 1-3 under PDR accession No. 8607230275. You may find documents 4 and 5 in the PDR under Commission Correspondence - August 26, 1986, response from Carlton Kammerer, Office of Congressional Affairs to Congressman Markey's June 30, 1986, letter.

l l Documents 2, 4, and 5 have been released in their entirety. Portions of

! documents 1 and 3 have been withheld pursuant to Exemptions (7)(C) and (7)(D) of the F0IA, 5 U.S.C. 552(b)(7)(C) and (7)(D), and 10 CFR 9.5(a)(7)(iii) and (iv) of the Commission's regulations. The withheld portions consist of personal privacy information the disclosure of which would constitute an unwarranted invasion of privacy and confidential source information.

Pursuant to 10 CFR 9.15 of the Commissinn's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Ms. Sharon R. Connelly, Director, 01A These denials may be appealed to the Secretary of the Connission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U. S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
