Dear. Mr. Chilk's :
This is an appeal,- pursuant to subsection (a) (6) of the Freedom of Information Act,-(FOIA), as amended.

On-November 20, 1985 ithe Government Accountability Project (GAP) submitted the enclosed request for a report (or roports) by the Office of Inspector.and Auditor (OIA) into charges that the Nuclear Regulatory Commission-(NRC) staff responded improperly to allegations-by
whistleblowers" at.the Diablo Canyon nuclear power
- plant, as well:as anyirecords related to the CIA report.
After more than six months, the NRC has not yet responded, either to provide or. withhold'the requested information.
Therefore, as, is ovr right under the statute, we consider the non-response to be a denial and hereby: appeal; At this time it'also.may be helpful to< clarify in writing the scope of the ongoing request.
As has been explained verbally to Mr. Isaacs of the.NRC staff, the request may include more than one OIA work product.
To illustrate, the roquest covers at least an CIA report of investigation into alleged, false statements, and an audit into non-compliance with agency procedures.
Thor oquest' also
- covers, inter alia, any prosecutive.roforrals to-the Department of Justice (DOJ),
and any DOJ' response (s) to the NRC. :
As provided by the Act, we will expect to roccivo a reply to this administrativo appeal within twenty working days.
