Dear Ms. Garde:

This is in further response to your letter dated July 22, 1986, in which you appealed Mr. Donnie H. Grimsley's letter dated June 25, 1986.

Mr. Grimsley's letter denied documents in part that were subject to your Freeaom of Information Act (F01A) request for documents related to the NRC Comanche Peak Task Force. My letter to you dated April 10, 1987, aadressed the agreement which was the basis for deleting certain information in the requested documents. This letter will adoress those portions of 188 documents listed on Appendix G which were initially denied pursuant to an F01A exemption. Mr. Chilk will respond separately concerning 73 documents.

Acting on your appeal, I have carefully reviewed the record in this case and have determined that additional information in one document, G-280, can now be made publicly available. The previously withheld information in the other 187 documents will continue to be withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. Your appeal is, therefore, partially granted and partially denied.

Document G-280 is now being made publicly available and is enclosed.

As stated in Mr. Grimsley's letter dated June 25, 1986, the withheld <

portions of the 187 documents relate to the subject of potential violations. The withheld portions were predecisional to the issuing of the enforcement action on Comanche Peak. Exemption (5) shields from mandatory disclosure information generated in the deliberative process that precedes most decisions of government agencies.

This is in further response to your letter dated Januarj 21, 1965, in which you requesteo, pursuant to the Freedom of Inforfration Act (FOIA), records related to the NRC Conanche Peak Task Force established in March 1984 We are now placing one additional box of records (box 6) in the QA/QC category, covering Appendix G records numbered 1 through 332 into the Public Document Room (POR) in file F0!A-85-59 under your name.

Portions of the records identified at numbers 95,140 through 158, 160 through 209,211 through 221, 223 through 239, 242 through 269, and 271 through 332 are being withheld from public disclosure U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of pursuant to Exenstion the Cortunission's 5 of the F0!A (5 regulations. The records contain the advice, opinions, and recomendattor.s of the staff concerning potential violations. The nonexempt portions of the records are being placed in PDR file F01A-85-59 under your name.

    • Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

This denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0!A Decision."
