Subject:

DELEGATION OF ADDITIONAL RULEMAKING AUTHORITY TO THE EXECUTIVE DIRECTOR FOR OPERATIONS Discussion: In a memorandum dated August 9, 1985, Secretary Chilk directed the General Counsel to draft regulations for Commission review which would delegate additional rulemaking authority to the Executive Director for Operations (EDO).

The Secretary indicated that a majority of the Commission supported granting the EDO the authority to issue (1) minor rules under Part 0 (Conduct of Employees), 2 (Rules of Practice) and 110 (Export / Import) ; and (2) minor amendments of a non-policy or corrective nature to Commission regulations, including those in Parts 0, 2,7,8,9 Subpart C, and 110.

Attached for Commission consideration is a draft Federal Register notice implementing this delegation.

(Attachment 1) The delegation also requires modification of Manual Chapter 0103 (" Organization and Functions--

Office of the Executive Director for Operations"). Proposed changes to that manual chapter are attached for your review. (Attachment 2)

2 Recommendation: Approve this proposed final rule.for publication in the Federal^ Register and approve the changes to the NRC Manual Chapter.
