Dear Mr. Chairman:
I am writing to ensure that my understanding of the status of ,
low-power licensing for the Seabrook nuclear power plant is complete and up to date.
It is my understanding that the effect of the Atomic Safety and Licensing Board (ASLB) decision of July 25, 1986 (ASLBP No.
82-471-02-OL) is that the earliest possible date on which a low power license for Seabrook could be issued would be af ter the ASLB resolves three remaining contentions related to onsite emergency preparedness in a four-day hearing session scheduled to take place between September 29 and October 10, 1986.
Further, it is my understanding, confirmed by the Commission's Office of Congressional Affairs, that since a nuclear power plant also is required to have a low power license before commencing fuel loading, Seabrook will not be allowed to load fuel until after the October hearings have taken place and a 5% power license has been issued.
i l Please confirm in writing my understandings on both of these points no later than August 12, 1986. If my undrstandings are incorrect in any respect, please clarify them for me by the same date.
