Dear Mr. Chainnan:

In your letter of August 7,1986, you requested confirmation of your understanding of the current status of low-power licensing for the Seabrook Statiori, Unit 1 plant.

As noted in your letter, the Atomic Safety and Licensing Board issued an Order on July 25, 1986, scheduling a four-day hearing to take place between September 29 and October 10, 1986. The hearing will involve three contentions; one contention relates to onsite emergency planning, the other two involve the environmental qualification of electrical equipment and control room design.

Upon completion of this litigation, assuming there are no other contested issues relevant to a low power license, and in the event that the decision is favorable to the Seabrook Applicants, the Board could authorize the Staff to issue to Seabrook an operating ifcense restricted to 5% power.

Pursuant toS' ec. 50.57(c) of the Comission's rules, the Applicants could file a motion with the Licensing Board seeking a license to load fuel or a license for low-power operation before the completion of the hearings on one or more of the three contentions. In order to prevail on such a motion, the Applicants would have to demonstrate that the issues raised in such contentions are not relevant to the activities to be conducted at the requested power level. Without such a motion no license, including a license to load fuel, could be issued before all three contentions are heard and decided. As of this time, the Applicants have filed no such motion, and the Comission, of course, can offer no coment on the merits or the likelihood of success of any such motion.
