your office has convened a Board to consider whether a hearing l
should be granted on the application of Florida Power & Light Company (FPL) to transfer spent fuel between its St. Lucie units.

The letter does not, in even the most marginal way, meet the requirements for a petition to intervene under the Commission's rules.

It should have been disposed of by the Secretary as a " request for hearings
[which]
.. fails to comply with the Commission's pleading requirements and fails to set forth an arguable basis for further proceedings."

November 25, 1986 Page Two It is deeply disturbirg that the Commission's adjudicatory machinery would be set in motion by a communication of this type.
The expenditurc of time and money on the part of FPL to respond by way of pleadings to such a communication is unjustifiable; the concomitant activities of the Atomic Safety and Licensing Board Panel and the NRC Staff triggered by this action would constitute a misallocation of resources at a time of budgetary restraint throughout the Government and especially at the NRC.
Certainly its resources could be better expended upon other activities.
For all of the foregoing reasons, we request that the action convening the Board be rescinded and that Mr. Paskavitch's letter not be accepted for filing as a petition to intervene.
In view of the detriment to the public interest and the unnecessary expense involved, if you have any doubts regarding your authority to take such action we request that you refer this matter to the Commission.
