10 CFR 171 ANNUAL FEE EXEMPTION GUIDANCE REQUEST (TAC 63140)

Re: Big Rock Point Plant Pursuant to 10 CFR 171.11, Consumer Power Company (CPC), has indicated via telephone conference, intent to request an exemption to the annual fee requirements of 10 CFR 171.15 for Big Rock Point. By letter dated October 7, 1986 CPC requested additional guidance regarding acceptable justification and basis for exemption to 10 CFR 171.15.

NRC staff has reviewed CPC's reouest for additional guidance and has investigated the basis of the rulemaking and possible acceptable exemption bases. Our staff has been informed by NRC License Fee Management Staff that the only guidance currently available regarding acceptable basis for exemption is what is already published in the rule (see 51 FR 33224 dated September 18, 1986).

It is NRC staff's understanding that other licensees with relatively small reactors are considering similar actions with regard to the new annual fee requirements. Our staff recommends that CPC contact those facilities to discuss this matter.
