Dear Mr. Denton:
On November 3,1986, you were requested to issue an "Infurtherance Certificate" for certain facilities at Comanche Peak that are alleged to be for the purpose of abating or controlling air or water pollution.
The certificate specifically uses the phrase "as designed."
In light of the substantial uncertainty of the quality of the design for Comanche Peak, as evidenced by the " essentially 100% reinspection" that TUEC claims to be undertaking and the extensive proposed modification of design criteria that TUEC is requesting the NRC to approve, we believe it would be inappropriate for you to sign the certificate without first independently verifying that the facilities in question "as designed" will be "infurtherance of the purpose of abating or controlling" air or water pollution.
Since the "Infurtherance Certificate" is an essential component in deciding whether tax-exempt bonds should be issued, we believe it is particularly important that the NRC scrupulously review the underlying factual issues essential for issuance of the certificate before deciding whether to sign i t.
