3 MR. WARD:

Mr. King, I just wanted o mind you that 4

previously we discussed that you should be truthful with us in 5

any questions we asked you regarding the subject.

6 I am an investigator with the Office of the 7

Inspector and Auditor.

O What we want to discuss today is, while you were at 9

Three Mile Island, there was an allegation made by Mr. Parks, 10 Richard Parks, who contends that you have knowledge concerning 11 GPU Nuclear and Bechtel, that you were able to review Nuclear 12 Regulatory Commissson draft reports before they were finalized

14 Do you have knowledge of that?.

15 MR. KING:

The only knowledge I have is the presence 16 in Kanga's office and discussions, you know, just hearsay, 17 really, I would say the rest of it is, because, you know, 18 direct knowledge, no.

19 The only direct knowledge I have is, I was present 20 in Kanga's office, as i testified before, when Barrett called 21 over there and was on the loudspeaker, discussing a letter 22 that he was going to write, something to do with the waste.

28 He wanted to let GPU know that it was not going to 24 be a nice letter, it was going to be critical of them.

And i 25 remember Kanga saying, "Well, if you do that, we're going to

1, respond, and, you know, we are going to disagree with it."

2 MR. WARD:

Uas the letter ever written, do you know?

8 MR. KING:

I don't know.

4 And I also know, I was present at a meeting when the 5

NRC had represented that they were really unhappy with a 6

letter that Larsen, who was the Head of Licensing, responded 7

to.

The discussion was, all this stuff winds up in the public 8

document room.

9 He apparently had, NRC had and I don't know all 10 the details had written some letter, and Arnold was 11 present at this meeting we were all in a meeting -- and 12 apparently critical of GPU, and it turned out they had made a

13 mistake, and GPU just fired this barrage b,ack at'them.

And 14 Arnold directed Larsen at that particular-time, hey, any of 15 those discussions would be preceded by a phone call first 16 before they ever got into writing.

17 MR. WARD:

Okay.

But have you ever witnessed Lake 18 Barrett, who was the Project Officer or program Director at 19 Three Mile Island, have you ever witnessed him presenting a 20 draft letter to either Mr. Kanga, who was the Bechtel Vice 21 president at that time, or Mr. Arnold?

22 MR. KING:

No.

23 MR. WARD:

Do you have any knowledge of who parks

I don't know.

Okay.

I'm going to read something 'to you 15 and see if this will refresh your memory about that 16 conversation.

Maybe I'm talking about the wrong one.

17 This is where Kanga said that he was going to send a 18 letter demanding specific shipping date deadlines for some 19 highly radioactive Epicor, EP 1 COR (spelling), to 20 profilters if negotiations with the cask suppliers which was 21 causing them delay were not resolved in a timely fashion.

22 Barrett explained that Kanga had state,d that the letter would 28 allow the only two commercial suppliers of the required waste g

24 shipping casks to unfairly raise prices, and that Barrett 25 agreed not to send the letter for seven days, during which the I

problem necessitating the letter was resolved.

No, I don't think that's 'the 4

conversation.

I don't remember that conversation.

5 This is something that was going to be critical of 6

GPU's action in processing waste or something.

remember all the details.

8 MR. WARD:

Do you know of any other person or person O

that would know of this, other than Parks, about these 10 letters, drafts, and so forth?

11 MR. KING:

If there were any, I would imagine it 12 would be if anybody did know, it would be Barton.

18 MR. WARD:

And who is Barton?

14 MR. KING:

He was the Directorwof Administrative 15 Assistant to Kanga.

16 MR. WARD:

Do you remember his full name?

17 MR. KING:

John Barton.

Okay.

Do you have any other information about 21 these drafts that you could supply us at this time?

22 MR. KING:

No.

28 MR. WARD:

Basically that's all I wanted to

I was Interested in finding out possibly who the 25 sources were, and you said Barton, and whether you had direct

1 knowledge, which evidently you don't, other than the telephone 2

conversation.

8 Was that the only conversation you id hear, just i

5 MR. KING:

That's all that I was involved in.

O 1 know there were several, you know.

7 I know that Barrett used to come over and meet with 8

Arnold all the time, but I can't say what those discussions 9

were about, since nobody was predent except Arnold and 10 Barrett.

Okay.

Tom Devine didn't help you prepare that 6

No.

I had a separate lawyer.

over $7000 for those letters.

9 MR. RESNER:

Do you recall, was Tom Devine did he 10 visit your residence in Pennsylvania?

11 MR. KING:

Yes, he did.

And I think it was in ligh 12 of -- I think i explained this to everybody before.

At ne 13 time, they wanted me to -- when Parks found qut they were 14 going to get rid of him, you know, I think Chwestyk somehow 15 through Chwastyk, he got the word to Parks,'and I think Parks 16 already suspicioned by that by the conversation he had in my 17 office with me and, I forget who his supervisor was at the 18 time.

19 So he came back one day all excited, and he wanted 20 me to talk to GAP.

I guess I was 21 MR. RESNER:

That's Government Accountability?

22 MR. KING:

Yes, I guess I was suspended at that 28 particular time.

I'm trying to place the timeframe.

I guess 24 I was suspended at that particular t:me.

Okay.

You see, I didn't have all the 3

information that Parks had.

I didn't have a lot of the 4

documentation that he had.

I really had to rely on Rick to 5

support anything that I would say because, you know, I was out 6

on the street without very much paperwork at alI 7

MR. WARD:

I have one more question.

3 On March 11, 1993, Richatd Parks went to Joel iebe 9

and Fasano at Three Mile Island, and Parks athted that he had 10 information from Larry King that Bob Arnold, the President of 11 GPU Nuclear, was trying to get King to reveal the connection Qulltogk.

And Parks 12 between Parks and K i r g 's consulting firm,

,e 13 interpreted this as GDtl trying to set him upIto be fired.

14 MR. KING:

That's true.

Arnold kept asking me 15 and I taped that conversation, by the way, and that's all in 16 storage, and I told Neoks that and he asked im e several 17 timus, he was trying te get me to (nput -- nkey, Parks, and he he'd sit there and say, "Well, w h.s t about 18 kept, you know 19 Parks' involvement?"

And I'd say, "W4fl, what about Parks' 20 involvement?"

And I just got the feeling at the timu that i 21 knew then what was going on, because I think he went puhlic 22 with something around that time.

I can't remember exactly the 23 t6me.
