Items of Interest Week Ending JULY 24, 2020 Staff Hosted Public Meeting on Guidance for Assessing the Acceptability of Probabilistic Risk Assessment Results for Risk-Informed Activities On July 21, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20191A324) with industry representatives to discuss draft regulatory guide DG-1362 (draft RG 1.200, Revision 3), Acceptability of PRA [Probabilistic Risk Assessment] Results for Risk-Informed Activities (ADAMS Accession No. ML19308B636). When issued as final, RG 1.200, Revision 3, will enhance clarity of NRC staff expectations with respect to use of newly developed methods in PRA models, including the establishment of criteria licensees can use to adopt newly developed methods without prior NRC approval. The NRC staff plans to issue RG 1.200, Revision 3, after appropriately dispositioning public comments; the public comment period on DG-1362 expires on July 31, 2020 (85 Federal Register 39599).

Staff Hosted Public Meeting to Discuss Treatment of Seismic Risk On July 21, 2020, the NRC held a public meeting with the Nuclear Energy Institute and the Electric Power Research Institute to discuss methods to account for seismic risk in applications submitted under Section 50.69 of Title 10 the Code of Federal Regulations (10 CFR), Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors. Specifically, the staff and industry discussed methods to quantify seismic risk for sites with a relatively low seismic hazard. The staff plans to work with industry to schedule a pre-submittal public meeting for an actual amendment request to provide more concrete feedback on the proposed methods.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. A complete list of licensing actions approved by the NRC in response to the COVID-19 public health emergency is available on the NRC public website at https://www.nrc.gov/about-nrc/covid-19/reactors/licensing-actions.html.

On July 24, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (85 FR 44685) confirming the effective date of August 17, 2020, for the direct final rule that was published in the Federal Register on June 2, 2020 (85 FR 33527). This direct final rule amends the NRCs regulations to comply with the Social Security Number Fraud Prevention Act, signed on September 15, 2017. The effective date of August 17, 2020, for the direct final rule is confirmed.

On July 22, 2020, the NRC published a notice in the Federal Register (84 FR 44145) confirming the effective date of July 27, 2020, for the direct final rule that was published in the Federal Register on May 13, 2020 (84 FR 28479). The direct final rule amends the NRCs spent fuel storage regulations by revising the Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 5 to Certificate of Compliance No. 1032. The effective date of July 27, 2020, for the direct final rule published May 13, 2020, is confirmed.

Emergency Preparedness for Small Modular Reactors and Other New Technologies:

Proposed Rule and Guidance; Request for Comment; Extension of Comment Period; 10 CFR Parts 50 and 52 (RIN 3150-AJ68; NRC-2015-0225)

On July 21, 2020, the NRC published a notice in the Federal Register (84 FR 44025) extending the comment period for a notice published in the Federal Register on May 12, 2020 (85 FR 28436) proposing to amend its regulations to include new alternative emergency preparedness requirements for small modular reactors and other new technologies. The public comment period was originally scheduled to close on July 27, 2020. The NRC is extending the public comment period to allow more time for members of the public and other stakeholders to develop and submit their comments. The comment period for the document published on May 12, 2020 is extended. Comments should be filed no later than September 25, 2020.

NMSS Staff Reviewing Update to National Environmental Policy Act Regulations On July 16, 2020, the Council on Environmental Quality (CEQ) published in the Federal Register a final rule (https://www.govinfo.gov/content/pkg/FR-2020-07-16/pdf/2020-15179.pdf) to update its regulations for Federal agencies to implement the National Environmental Policy Act (NEPA). This is CEQs first comprehensive update to its regulations since their promulgation in 1978. The NRCs longstanding position is that the CEQs NEPA implementing regulations are AUGUST 7, 2020 ENCLOSURE D

not binding on the NRC; however, as a matter of policy, the NRC has closely patterned its NEPA implementing regulations on CEQs regulations since 1984 (when the current NRC Title 10 of the Code of Federal Regulation (10 CFR) Part 51 regulations were originally promulgated). The NMSS staff is currently reviewing the recently promulgated CEQ regulations to determine what changes to NRC regulations or procedures would be appropriate.

NMSS Issues Amendment to General Electric Hitachi On July 16, 2020, NMSS staff issued an amendment to license Special Nuclear Material - 1270, to General Electric (GE) Hitachi for transportation of radioactive material. This license modification will enable GE Hitachi to take possession of Accident Tolerant Fuel rod segments in order to transport them via private carriage to Oak Ridge National Laboratory this fall for post-irradiation examination, without negatively impacting public health and safety.

NMSS Staff Hosts Public Meeting on Holtec Topical Report On July 17, 2020, NRC staff held a public meeting with Holtec International (Holtec) representatives to discuss the review of the Topical Report (TR) for Allowance of Heat Load Patterns in HI-STORM 100 and HI-STORM FW Dry Cask Storage Systems. Holtec representatives discussed a new methodology that could provide additional flexibility in cask loading strategies. Spent fuel movement from the pool to dry cast storage could occur earlier, with fewer amendments needed, for various heat loading patterns. NRC staff plans to implement the new TR Modified Review process and One-Year schedule as part transforming spent fuel storage reviews. NMSS Staff Approve Exemption for BWXT On July 21, 2020, the NMSS staff approved an exemption (ADAMS Accession No. ML20153A474), requested by BWXT Nuclear Operations Group, Inc. - Lynchburg, from reporting certain unplanned contamination events. This exemption does not alter reporting requirements for an unplanned contamination event that occurs outside of an established contamination-controlled area. The staff reviewed the request and determined it will not endanger life or property or the common defense and security and is otherwise in the public interest. A similar exemption request was recently approved for Global Nuclear Fuel -

Americas, LLC.

Items of Interest Week Ending JULY 24, 2020 Employee Health and Wellness Services On July 13, 2020, the indefinite quantity, indefinite delivery contract 31310020D0012 was awarded to the EAGLE HEALTH LLC in Manassas, VA. The purpose of this award is to provide the necessary personnel, management, administrative and technical services required to operate a successful Health and Wellness Services Program for the U.S. Nuclear Regulatory Commissions (NRCs) employees. The period of performance of this contract is from August 1, 2020, through July 31, 2025. The total potential value over the life of the award is

$7,000,000.00.

Independent Verification and Validation Support Services On July 20, 2020, the NRC established two Blanket Purchase Agreements (BPAs) under General Services Administration (GSA) Federal Supply Schedule contracts. Individual BPA Calls will be competed between the two vendors. The first BPA, 31310020A0003, was established under the GSA contract 47QTCA19D00G9 to TESTPROS INC in Sterling, VA, on July 20, 2020. The second BPA, 31310020A0004, was established under the GSA contract GS35F125S to AEGISNET INC in Merrifield, VA, also on July 20, 2020. These agreements provide the NRC with a broad range of support services that will include independent baseline reviews of information technology systems, compliance reviews, quality assurance reviews, program and project reviews, feasibility studies, as well as technology assessments, business case development support, system integration planning, and system and acceptance testing.

The period of performance of these BPAs is from July 20, 2020 through July 19, 2028. The total potential value over the life of the agreements is $44,000,000.00.
