APPENDIX A NOTICE OF VIOLATION Combustion Engineering, Inc. Docket No. 70-1100 As a result of the inspection conducted on August 18-22, 1986, and in accordance with the General Statement of Policy and Procedure for NRC Enforcement Actions,10 CFR Part 2, Appendix C (Enforcement Policy,1986),

the following violations were identified:

A. Section 4.3, " Specific Criticality Safety Criteria", of your NRC-approved license application (Part 1 - Criteria), dated September 16, 1983, states, in paragraph 4.3.2, that the fire door on the virgin powder prep storage area shall close automatically on activation of the fire alarm and upon electrical power failure. The automatic closing feature of the door on the virgin powder storage area shall be verified (to be operable) quarterly, and records of its performance shall be maintained.

Contra'ry to the above, between January 3, 1984 and August 18, 1986, automatic closing of the fire door on the virgin powder prep storage area was not verified to be operable, on a quarterly basis, under the conditions of electrical power failure.

This is a Severity Level IV violation (Supplement VI, D).

B. Section 2.2.2, " Nuclear Fuel Manufacturing - Windsor", of your NRC-ap-proved license application (Part 1 - Criteria) states that the General Manager has delegated to the Production and Material Control Manager, and to the Engineering Manager, responsibility to assure that all operations involving nuclear materials have been analyzed to establish the required safety limits and controls. The Manager, Nuclear Licensing, Safety, Accountability and Security or the Nuclear Criticality Specialist shall assist the Engineering Manager and the Production and Material Control Manager by performing the analysis required and by establishing the appropriate controls.

Contrary to the above, on August 21, 1986, the inspectors determined that natural uranium rods were being stored on top of a 3.7 inch safe slab of uranium oxide in the Building 2 vault, and this storage configuration had not been analyzed to establish the required safety limits and controls.

This is a Severity Level IV violatton (Supplement VI, D).

Appendix A 2 Pursuant to the provisions of 10 CFR 2.201, Combustion Engineering, Inc.

is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the resuits achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
