MAY 3,-1984 2.206 PETITION FROM GAP RE: DIABLO CANYON By the enclosed Petition dated May 3,1984, Thomas Devine, on behalf of the Mothers for Peace and the Government Accountability Project submitted an additional request for action concerning the Diablo Canyon Nuclear Power Plant. The request augments its earlier _ requests and relies on allegations previously submitted as well as the infomation included with this Petition.

The Petition requests that any decision on ascension above 5% power be deferred until certain actions, to be ordered by the Comis-sion by May 11, 1984, are completed.

The actions recuested include:

1) additional re-evaluation of design, design control and construction activities under the direction of an independent third party; 2) a review of Diablo Canyon's character and competence by means of an independent management audit and OI investigation of intimidation and harassment; and 3) an investigation of possible misleading statements by the NRC staff to the Comdission during recent briefings.

Although no decision on whether the information submitted supports initiation of the requested actions is necessary by the May 11, 1984 dat,e specified in the Petition, an acknowledgement letter should be sent promptly.

We have enclosed a draft of such a letter for your use.
