Marquette University License No. 48-02931-06 License No. SNM - 1039 License No. SUB - 231 (Expired)
As a result of the inspection conducted from August 4 through 6, 1986, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violations were identified:
License No. 48-02931-06 1.
License Condition No. 19 requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applications and letters.
The referenced letter dated July 5,1983, states in part that upon opening packages of radioactive material that bear detection by survey meters, the authorized user will survey all packing material.
Contrary to the above, in 1985 and 1986, all users did not survey packing material upon opening packages of radioactive material that bore detection by survey meters.
Specifically, several users stated that they did not survey packing material upon opening packages of millicurie quantities of phosphorus-32 and calcium-45.
This is a Severity Level IV violation (Supplement VI).

License Condition No. 19 requires that licenced material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applications and letters.
The referenced letter dated July 5, 1983, states in part that the waste storage room, A101 in the Dental Annex, will be surveyed once each week and the results recorded.

Contrary to the above, in 1985 and 1986, this room was not surveyed weekly.
This is a Severity Level IV violation (Supplement VI).

I The referenced letters dated May 4,1979, and July 5,1983, state that each time a disposal is made into the barrels in the waste storage room, Room A101 in the Dental Annex, the investigator will record the identity of the isotope and the quantity disposed in a log maintained in this room.

2 Contrary to the above, investigators were not recording the identity of the isotope and the quantity disposed each time a disposal was made.
Specifically, on the day of the inspection, the inspector found a vial labeled as containing 25 millicuries of carbon-14 in a barrel.
The log for this barrel did not list that item.
In addition, the inspector measured with a portable G-M survey meter, exposure rates at the surface of another waste barrel and outside the wooden door to the storage room, approximately 3 and 1 milliroentgens/ hour, respectively.
The log for this barrel did not list an isotope that would give readings with these radiation levels.
This is a Severity Level IV violation (Supplement VI).
License No. SNM-1039 4.
License Condition No.15(B) requires that the test for leakage of the encapsulated plutonium source be capable of detecting the presence of 0.005 microcurie of contamination on the test sample.
Contrary to the above, the licensee's test for leakage was not capable of detecting 0.005 microcurie of contamination.
Specifically, a licensee representative did not know the detection efficiency of the counting system used to analyze test samples.
This is a Severity Level IV violation (Supplement VI).
License No. SUB-231 (Expired) 5.
10CFR40.3 states, in part, that no person shall posses or use source material except as authorized in a specific license issued by the Commission pursuant to the regulations in 10CFR40.
i Contrary to the above, Marquette University possesses source material without authorization in a specific license.
Specifically, Marquette University's specific license to posses source material expired on May 31, 1984 and the University still possess 2500 kilogram of natural uranium metal.
This is a Severity Level IV violation (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written _ statement or explanation in reply, including for each violation:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
