ORDER IMPOSING CIVIL MONETARY PENALTIES I
Florida Power Corporation (the licensee) is the holder of Operating License No. DPR-72 (the license) issued by the Nuclear Regulatory Commission (the Commission). The license authorizes the licensee to operate the Crystal River Unit 3 facility in accordance with conditions specified therein. The license was issued on December 3, 1976.

A speciel safeguards inspection of the licensee's activities under the license was con;ucted on' January 2-3, 1986. 'The inspection determined that the licensee had not conducted its activities in full compliance with the conditions of its license. A written Notice of Violation and Proposed Imposition of Civil Penalties was served upon,the licensee by letter dated April 16, 1986. The Notice stated the nature of the violations, the requirements of the Commission that the licensee had violated, and the amount of the civil penalties proposed for the violations in the Notice. A response to the Notice of Violation and Proposed Imposition of Civil Penalties dated May 30, 1986 was received from the
'l licensee.
In the licensee's May 30, 1986 response it requested a meeting with the NRC which was held in Bethesda, Maryland on June 30, 1986. During this meeting the licensee provided furthe'r information concerning its assertions in O

. Upon consideration of the licensee's response and the statements of fact, i
explanation, and argument for mitigation. contained therein and its further explanation of the response in the June 30, 1986 meeting, the Director, Office of Inspection and Enforcement has determined, as set forth in the Appendix to this Order, that Violations C and E should be withdrawn and that the penalties proposed for the violation in the Notice of Violation and Proposed Imposition of Civil Penalties should be reduced to Fifty Thousand Dollars ($50,000).
III In view of the foregoing and pursuant to Section 234 of the Atomic Energy Act of 1954, as amended (42 U.S.C. 2282, PL 92-295), and 10 CFR 2.205, IT IS HEREBY ORDERED THAT:

($50,000),within thirty days of the date of this Order by check, draft, or money order payableito the Treasurer of the United States and mailed to the Director, Office of Inspection and Enforcement, U.S. Nuclear Regulatory l
Commission, Washingtop, D.C. 20555.
IV The licensee may, within thirty days of the date of this Order, request a hearing. A request for a hearing shall be addressed to the Director, Office of Inspection and Enforcement, U.S. Nuclear Regulatory Commission, Washington, D.C.

If a hearing is requested, the Commission will issue an Order designating the time and place of the hearing.
If the licensee fails to request a hearing within thirty days of the date of this Order, the provisions of this Order shall be effective without further proceedings, and if payment has not been made by that time, the matter may be referred to the Attorney General for collection.
V In the event the licensee requests a hearing as provided above, the issues to be considered at such hearing shall be:

(a) whether the licensee was in violation of the Commissilin's requirements as I
set forth in Items A, B and D in the Notice of Violation an'd Proposed Imposition of Civil Penalties referenced in Section II above, and r
l (b) whether, on the basis of such violations, this Order should be sustained.
