Regulatory Comission (FERC) and state Public Utility Comissions (PUC's) in dealing with.the economic issues involved in order to relieve NRC from dealing any more than necessary in an area with which we are not familiar. We have

considered this question, have discussed it with the Office of State Programs, since they play a major role at NRC in evaluating utility financial issues, and ,

have also discussed it with FERC staff and with the Chairman of the Comittee ,

l The question of the roles of NRC, FERC, and the PUC's in this area should first '

consider the responsibilities of each of these entities. NRC is, of course, responsible for protecting the public health and safety during the construction, operation, and decomissioning of nuclear facilities.. As part of assuring public health and safety, the NRC has issued a number of rules in the general area of financial criteria: Part 40 Appendix A. Criterion 9 (on assuring that sufficient funds will be available to carry out decomissioning and decontamination of uranium mills and for reclamation of any tailings or waste disposal areas); Part 50.33f (on demonstrating to the Comission the -

financial qualification for licensed activities); Part 50.54w (on obtaining -

onsite property damage insurance to assure adequate funds for decontamination after an accident); Part 61, Subpart E, section 61.62 (on providing assurance that sufficient funds will be available to carry out closure and stabilization i

i The Federal Energy Regulatory Commission has the responsibility for setting l rates for the transmission and sale (wholesale) of electricity by investor owned utilities in interstate commerce and au+horizes the conditions, rates, I and charges for interconnections among electric utilities. The sales of I electricity for which FERC would set rates are small, comprising about 13 percent of total U.S. electricity sales. State public utility commissions have the responsibility for setting rates for retail sales of electricity to l homeowners and companies doing business in their states. Municipally-owned, state-owned, or Federally-owned utilities, and rural electric cooperatives generally do not come under the jurisdiction of FERC or the state PUC's and thus set thcir own rates, including collections for decommissioning funding.
