STATE OF TEXAS BUREAU OF RADIATION CONTROL REQUEST TO REVIEW AN IN-SITU LEACH FACILITY ISSUE ON RECLAMATION John Lusher of my staff received a telephone call from Eugene Forrer, Chief, Uranium Licensing Project, Division of Licensing, Registration, and Standards, Bureau of Radiation Control (BRC), Texas Department of Health. He was asked if he would look at some information supplied by one of their in-situ leach (ISL) facilities in the process of reclamation (Attachment 1). The Texas BRC has requested the Nuclear Regulatory Commission's position regarding this licensee's proposal for on-site disposal prior to license termination.

We have prepared a technical response which you can attach to a letter responding to the State of Texas' request (Attachment 2).
