The Texas Bureau of Radiation Control (BRC) has requested the Nuclear Regulatory Commission's (NRC) position regarding an in-situ leach (ISL) licensee proposal for on-site -

disposal prior to license termination.

Technical Evaluation:

After a telephone conversation with Eugene Forrer, Chief, Uranium Licensing Project, Division of Licensing, Registration, and Standards, BRC, and reviewing the material which was faxed to NRC, the NRC staff agrees with the BRC recommendation. Our understanding is that the BRC recommends that intercontinental Energy Corporation be required to meet 5 pCi/gm, averaged over the first 15 centimeters (6 inches) of soll below the surface; and 15 pCi/gm, averaged over 15 centimeters (6 inches) layers of soil more than 15 centimeters (6 Inches) below the surface, as specified in 10 CFR 40, Appendix A, Criterion 6(6).

Based on 10 CFR 40, Appendix A, Criterion 2, the NRC licensed in-situ leach uranium facilities have license conditions that require them to dispose of contaminated materials in a licensed tailinge impoundment or disposal facility. This is done to reduce the number of small radioactive material impoundments that would have to be licensed for permanent disposal of 11e.(2) byproduct material under Appendix A,10 CFR Part 40, and eventually for long-term surveillance and monitoring under 10 CFR 40.28. The material should be cleaned up and disposed of in a licensed tailings impoundment or disposal facility. To date, the NRC has made no exceptions to this criterion at ISL sites.
