On January 9,1986 the Board Chaiman (but not the other Board members) received a letter from Ms. Patty Miriello. Although I have not read Ms. Miriello's letter except to detennine its general nature, it is I am apparent that it is an ex parte communication under 10 CFR 2.780.

therefore serving the letter and its attachments on counsel for the parties participating in the drug contention (WB-3), as required by 10 CFR 2.780(b).

r 2-Ms. Miriello's testimony on Centention WB-3 was presented to the Board on October 3,1985 by Mr. Runkle, counsel for the Conservation Council of North Carolina.

I ask Mr. Runkle to direct Ms. Miriello to refrain from submitting ex parte communications to me or other Board members. The record in this proceeding was closed on November 12, 1985 and further information concerning the issues pending before the Board cannot be considered absent a reopening of the record. We anticipate that the staff will review this letter and investigate any safety concerns.
